₹22,000 Crore Claims, ₹6.5 Crore Repayment: The Subhash Chandra Insolvency Case Raises a Bigger Question—Why Do Ordinary Borrowers and Corporate Defaulters Face Such Different Outcomes?

India’s largest private lender, HDFC Bank, has announced that it is considering an appeal before the National Company Law Appellate Tribunal (NCLAT) after the National Company Law Tribunal (NCLT) approved a personal insolvency repayment plan for Essel Group founder Dr. Subhash Chandra. Under the approved plan, admitted creditor claims of about ₹22,006 crore would be settled through a repayment of approximately ₹6.5 crore, a decision that has generated intense legal and public debate. Several lenders reportedly opposed the plan and are exploring legal remedies.

Who is Subhash Chandra?

Subhash Chandra is one of India’s best-known media entrepreneurs and the founder of the Essel Group and Zee Entertainment Enterprises. For decades, Zee transformed India’s television industry and became one of the country’s largest media networks.

However, the Essel Group later faced severe financial stress following aggressive expansion into infrastructure, road projects, power, real estate and media businesses. Several group companies borrowed heavily, and financial distress eventually resulted in defaults, restructuring and insolvency proceedings.

What is this Insolvency Case About?

The current proceedings relate primarily to personal guarantees that Subhash Chandra had provided for loans taken by certain Essel Group companies. Under India’s Insolvency and Bankruptcy Code (IBC), lenders can invoke such guarantees if the principal borrowers default.

Subhash Chandra has argued that many of the underlying corporate borrowings have already been substantially repaid or are secured by assets, and that the claims against him personally should not automatically translate into his personal liability. Creditors opposing the plan disagree and have challenged the recovery amount.

The Larger Public Question

The controversy has revived an uncomfortable debate across India.

When an ordinary borrower defaults on a housing loan, education loan, vehicle loan or small business loan, recovery proceedings often begin quickly. Notices are issued, credit scores are affected, assets may be attached, and recovery agencies become active.

Yet when disputes involve thousands of crores and large corporate groups, restructuring, negotiations, insolvency mechanisms and lengthy litigation often continue for years.

This perception has led many citizens to ask:

  • Does India’s financial system treat wealthy corporate borrowers differently from ordinary citizens?
  • Are insolvency laws balancing revival and recovery, or unintentionally rewarding financial failure?
  • Are banks adequately protecting depositors’ money while accepting deep “haircuts” in insolvency cases?

These are legitimate public-interest questions, but each case depends on its own legal and financial facts.

What Banks Say

Banks argue that insolvency resolutions are often preferable to endless litigation because recovering even part of a distressed loan may be better than recovering nothing. They also state that decisions are taken collectively by creditors under the framework established by the Insolvency and Bankruptcy Code.

In this case, HDFC Bank says it opposed the approved plan and is examining an appeal before the NCLAT.

Questions That Deserve Investigation

The present controversy should prompt deeper scrutiny by journalists, regulators and policymakers:

  • Were all creditor claims correctly admitted?
  • Were sufficient assets available for recovery?
  • Were guarantees invoked in accordance with law?
  • Did lenders exercise proper due diligence before sanctioning loans?
  • Should Parliament revisit personal insolvency provisions under the IBC?
  • How much public money has ultimately been recovered from major corporate insolvency cases compared with the original exposure?

This case is no longer merely about one businessman or one bank.

It has become a test of public confidence in India’s banking and insolvency system.

If a small borrower loses property over relatively modest dues while disputes involving thousands of crores result in prolonged litigation and substantial reductions in recoverable amounts, citizens will inevitably question whether justice is being applied uniformly.

The final legal outcome will now depend on appellate proceedings before the NCLAT and, if necessary, higher courts. Until then, the issues remain under judicial consideration. What is beyond dispute, however, is that transparency, accountability and equal application of the law are essential to preserving public trust in India’s financial system.
